REGULATIONS OF THE BEST-GRANIT.COM ONLINE STORE [best-granit.com]
I. Definitions
The terms used in the Regulations mean:
1. Customer – a natural person, a legal person or an organizational unit that is not a legal person, to which special provisions grant legal capacity, who places an Order in the Store;
2. Consumer – in accordance with Art. 22[1] of the Civil Code means a natural person performing a legal transaction with an entrepreneur that is not directly related to his or her business or professional activity.
3. Civil Code – Act of April 23, 1964 (Journal of Laws No. 16, item 93, as amended); 4. Regulations – these Regulations for the provision of electronic services within the BEST-GRANIT.COM online store;
5. Online store (Store) – online service available at www.best-granit.com, through which the Customer may, in particular, place Orders;
6. Goods – products presented in the Online Store;
7. Sales contract – a contract for the sale of Goods within the meaning of the Civil Code, concluded between BEST-GRANIT.COM, concluded using the Store’s website;
8. Consumer Rights Act – Act of May 30, 2014 on consumer rights (Journal of Laws of 2014, item 827);
9. Act on the provision of services by electronic means – Act of July 18, 2002 on the provision of services by electronic means (Journal of Laws No. 144, item 1204, as amended);
10. Order – the Customer’s declaration of will, aimed directly at concluding a Sales Agreement, specifying in particular the type and number of Goods.
II. General provisions
1. These Regulations define the rules for using the online store available at www.best-granit.com.
2. These Regulations are the regulations referred to in Art. 8 of the Act on the provision of electronic services.
3. The BEST-GRANIT.COM online store, operating at www.best-granit.com, is run by BEST GRANIT sp. z o. o., NIP: 7822965448, REGON: 54391588000000, KRS: 0001221686, e-mail: biuro@best-granit.com, Szczepankowo 109a, 61-306 Poznań.
4. These Regulations specify in particular:
– rules for registering and using the account in the online store;
– terms and conditions for placing Orders electronically in the online store;
– rules for concluding Sales Agreements using the services provided in the Online Store.
5. In order to use the online store, the Customer should obtain access to a computer station or terminal device with Internet access on his own.
6. In accordance with applicable law, www.best-granit.com reserves the right to limit the provision of services via the Online Store to persons who are over 18 years of age. In such a case, potential customers will be notified about the above.
7. Customers can access these Regulations at any time via the link on the main page of the website www.best-granit.com and download and print them.
III. Rules for using the Online Store
1. Registration in the Online Store is optional. The Customer may place an order without registering in the Store, after reading and accepting these Regulations.
Registration takes place by completing and accepting the registration form available on one of the Store’s pages.
The condition for registration is to agree to the content of the Regulations and to provide personal data marked as mandatory. BEST-GRANIT.COM may deprive the Customer of the right to use the Online Store, and may also limit his/her access to some or all of the resources of the Online Store, with immediate effect, in the event of a breach by the Customer of the Regulations, and in particular when the Customer:
– provided during registration in the online store untrue, inaccurate or outdated data, misleading or violating the rights of third parties,
– has violated the personal rights of third parties, in particular the rights of third parties, via the online store personal data of other customers of the online store,
– commits other behaviors that will be considered by BEST-GRANIT.COM as behavior inconsistent with applicable law or general principles of using the Internet or detrimental to the good name of BEST-GRANIT.COM.
A person who has been deprived of the right to use the online store cannot register again without the prior consent of BEST-GRANIT.COM.
2. In order to ensure the security of the transmission of messages and data in connection with the services provided on the Website, the Online Store takes technical and organizational measures appropriate to the level of risk to the security of the services provided, in particular measures to prevent unauthorized persons from obtaining and modifying personal data sent on the Internet.
Personal data described in detail in the Privacy Policy section are processed in accordance with the provisions of applicable law, as well as the Regulation of the European Parliament and of the Council (EU) of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (referred to as “GDPR” or “General Data Protection Regulation”).
After completing the provision of services related to processing, depending on the Customer’s decision, BEST-GRANIT.COM deletes or returns all personal data to the Customer, as well as deletes all existing copies thereof, unless European Union law requires the storage of personal data.

3. The Customer is obliged in particular to:
– use the Online Store in a manner consistent with the provisions of the law in force in the territory of the Republic of Poland, the provisions of the Regulations, as well as with the general principles of using the Internet.
– not to provide or transfer content prohibited by law, e.g. content promoting violence, defamatory or violating personal rights and other rights of third parties,
– using the Online Store in a way that does not disrupt its functioning, in particular through the use of specific software or devices,
– not taking actions such as: sending or posting unsolicited commercial information (spam) in the Online Store,
– using the Online Store in a way that is not inconvenient for other customers and for BEST-GRANIT.COM,
– using all content posted in the Online Store only for your own personal use
IV. Procedure for concluding a Sales Agreement
1. In order to conclude a Sales Agreement via the Online Store, please visit the website www.best-granit.com and select the Goods by taking further technical steps based on the messages displayed to the Customer and the information available on the website.
2. The Customer selects the ordered Goods by adding them to the cart.
3. When placing an Order – until the button confirming placing the Order is pressed – the Customer has the opportunity to modify the entered data and the selected Goods. To do this, follow the messages displayed to the Customer and the information available on the website.
4. After the Customer using the Online Store provides all necessary data, a summary of the placed Order will be displayed. A summary of the placed Order will include, among others: a description of the selected goods or services, the total price and all other costs.
5. In order to send an Order, it is necessary to accept the content of the Regulations, provide personal data marked as mandatory and press the button confirming the submission of the Order.
6. Information about the Goods provided on the Store’s website constitutes an offer within the meaning of Art. 66 of the Civil Code. Sending the Order by the Customer constitutes a declaration of will to conclude a Sales Agreement with BEST GRANIT.PL, in accordance with the Regulations. The contract is considered concluded when the Customer’s Order is entered into the Online Store’s IT system, provided that the Order complies with the Regulations. After concluding the contract, the Customer receives an e-mail containing confirmation of all important elements of the Order.
7. The sales contract is concluded in Polish, with content consistent with the Regulations.
8. Customers can access these Regulations at any time via the link on the main page of the website www.ganit-sklep.pl, download it and print it out.
9. By placing an order, the customer declares that he knows and accepts the shipping time given on the product page. The shipping time is given under the product price and in the basket, in the order summary section.
V. Delivery
1. Delivery of Goods is limited to the territory of the Republic of Poland and the European Union and takes place to the address indicated by the Customer when placing the Order.
2. Delivery of the ordered Goods is carried out via:
– Courier company
Delivery costs are: Shipping on a pallet – PLN 330/1 pallet up to 1000 kg. Payment on delivery – additional 5% of the order value. Shipping abroad – priced individually. Additionally, delivery costs will be indicated when placing the Order or after placing the order for products with delivery priced individually.
3. The delivery deadline is given on the page of a given product and is counted from the next business day after the payment is received – for orders paid by traditional transfer; from the next business day after placing the order – for orders payable on delivery or by quick transfer.
4. Damage to the Goods occurring during delivery. In the case of a Customer who is a Consumer: in the case of a consumer distance purchase, the online seller always bears the risk of accidental damage or loss of the goods during transport. If, after receiving the Goods, you find any damage resulting from transport, please contact our store.
The provisions regarding filing complaints are included in point. VIII of these Regulations.
VI. Prices, payment methods and billing
1. The prices of the Goods are given in Polish zloty and include all components, including VAT (with the indication of the rate), customs duties and all other components.
2. The customer can pay the fee:
– by transfer;
– cash on delivery;
– by payment in the tpay system.
3. The payment card operator is PayPro SA Agent Rozliczeniaowy, ul. Kanclerska 15, 60 327 Poznań, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court Poznań – Nowe Miasto i Wilda in Poznań, 8th Commercial Division of the National Court Register under KRS number 0000347935, NIP 7792369887, REGON 301345068.
4. The invoice or invoice for the order is sent in electronic form to the e-mail address provided in the order within three business days of shipping the order
VII. Individual quotes and inquiries
Individual product valuations and responses to inquiries submitted outside the online store (e.g. by e-mail or during telephone contact) are for information purposes only and do not constitute an offer within the meaning of Art. 66 §1 of the Civil Code.
VIII. Right to withdraw from the contract
Only the Customer who is a Consumer is entitled to a 14-day period to withdraw from the contract. Pursuant to Art. 22 (1) of the Civil Code, a Consumer is considered a natural person who performs a legal transaction with an entrepreneur that is not directly related to his or her business or professional activity.

In order to effectively withdraw from the contract, the Consumer must return the products to the BEST-GRANIT.COM store within 14 days from the date of delivery to the Buyer. Before returning, you must determine the warehouse address with the store staff.
In the case of returned products for which there is no right to withdraw from a distance contract or defective products, BEST-GRANIT.COM may charge a fee for storing the product after seven calendar days from sending a request to the Referring Party to collect the products from the BEST GRANIT.PL warehouse. The costs associated with returning the goods are borne by the ordering party, the additional fee for non-contractual storage of the goods in the BEST-GRANIT.COM warehouse is PLN 15.00 gross per 1 calendar day for each pallet/packaging.
IX. Complaints regarding the Goods
1. BEST-GRANIT.COM as a seller is liable to the Customer who is a Consumer within the meaning of Art. 22[1] of the Civil Code, under the warranty for defects to the extent specified in the Civil Code, in particular in Art. 556 and art. 556[1]-556[3] et seq. of the Civil Code.
2. Complaints resulting from the violation of rights guaranteed by law or under these Regulations should be sent to the following address: BEST-GRANIT.COM, biuro@best-granit.com. The Seller undertakes to respond to the complaint within14 calendar days from the date of its receipt. Lack of response within this period means that the complaint will be accepted.
3. BEST-GRANIT.COM is not the manufacturer of the Goods, but all Goods available in the Store are covered by the warranty of BEST-GRANIT.COM as the seller. BEST-GRANIT.COM is liable for the warranty of the sold Goods under the conditions and for the period indicated in the warranty card. The manufacturer may bear independent liability under the warranty of the sold Goods under the conditions and for the period indicated in the warranty card issued by the manufacturer. If the manufacturer’s warranty document provides for such a possibility, the Customer may submit his claims under the warranty directly to the authorized service center whose address is included in the warranty card.

X. Complaints regarding the provision of electronic services
1. BEST-GRANIT.COM takes steps to ensure the fully correct operation of the Store, to the extent that results from current technical knowledge, and undertakes to remove any irregularities reported by Customers within a reasonable time.
2. The Customer is obliged to immediately notify BEST-GRANIT.COM about any irregularities or interruptions in the operation of the Online Store website.
3. The Customer may report irregularities related to the operation of the Store in writing to the following address: best-granit.com, biuro@best-granit.com
4. In the complaint, the Customer should provide his name and surname, correspondence address, type and date of occurrence of the irregularity related to the operation of the Store.
5. BEST-GRANIT.COM undertakes to consider each complaint within 14 days. Failure to consider the complaint within the above deadline means that it will be considered justified.

XII. Final provisions
1. The court competent to resolve disputes with Consumers is the court with local jurisdiction in accordance with the applicable provisions of the Code of Civil Procedure.
2. The settlement of any disputes arising between BEST-GRANIT.COM and a Customer who is not a Consumer will be submitted to the court having jurisdiction over our registered office.
3. In matters not regulated by these Regulations, the provisions of applicable law shall apply, in particular the provisions of the Act of April 23, 1964, Civil Code (uniform text, Journal of Laws of 2014, item 121, as amended) and the Act of May 30, 2014 on consumer rights (Journal of Laws of 2014, item 827). In the event of any conflicts between these Regulations and the rights of Customers and provisions arising from generally applicable provisions, generally applicable provisions of Polish law shall apply.
